Director of Property and Liability Claims

Annual Salary Range:$95,000 - $135,000

Type of Position: Full-Time (Possible Hybrid)

Education Requirement: Bachelor's Degree

Description and Details

The Director of Property and Liability, under supervision of the Trindel Insurance Fund Executive Director, is responsible for the management of claims staff; timely and accurate claims processing of all member property and liability claims from filing to closure, in accordance with Trindel Insurance Fund’s Claims Handling Guidelines. Works closely with member county staff, and attorneys; negotiate settlements to achieve the best possible outcome in the claim.

The Director of Property and Liability accomplishes this by analyzing loss trends, effective management of the claim cycle, setting/managing program reserves, conducting and directing investigations, site visits and active claim management. Includes prompt processing of claims for payment, implementation and execution of litigation management guidelines, excess carrier notification, managing the claim property and liability claims department staff to ensure they are handling claims in compliance with established claims handling guidelines while providing effective strategies that result in positive outcomes.

Overall responsibility to manage and direct operation of the Trindel Insurance Fund property and liability program.

Receives, reviews, and directs disposition of claims filed against member entities as well as the member entities first party property damage claims.

Establishes and maintains property and liability claim files, reserves, and loss data.

Responsible for investigation, evaluation of liability and damages, negotiating and settlement, litigation management, and final disposition of property and liability claims.

Overall responsibility for management of database and loss history.

Responsible for preparation of written reports, general correspondence, special reports, and projects related to property and liability claims.

Supervises and directs staff, outside adjusters, and attorneys in the handling and disposition of claims.

Attends settlement conferences, meetings, and trials as necessary to effectively manage litigated cases.

Attends Board, Member County Board of Supervisors Meetings, and Executive Committee meetings, reports on status of property and liability claims and makes recommendations as to action on claims.

Responsible for initial review of claims for coverage analysis.

Coordinates and communicates with Trindel’s excess insurance provider for coverage determinations related to property and liability claims.

Prepares reservations of rights notices, declinations of coverage and other communications to member entities relating to coverage and claim status.

Responsible for maintaining contact and communications with excess providers to assure proper reporting and recovery of excess recoverable and reportable matters.

Responsible for review and approval of service billings for investigative and legal services, forensic experts, and other service providers related to the claims function.

Skills required for the essential duties:

Knowledge of computerized spreadsheets and word processing.

Knowledge of risk management principles and programs.

Knowledge of insurance principles.

Knowledge of legal proceedings including depositions, interrogatories, dispositive motions, trials etc.,

Knowledge of excess insurance reporting procedures, limits and responsibilities.

Knowledge of claims settlement strategies and methodologies.

Skill in reading legal documents and court case proceedings to discern applicability to Trindel Insurance Fund and its members.

Skill in analyzing coverage.

Skill in preparing settlement terms, advice, negotiation and mediation strategies.

Skill in investigating claims details, logistics, and exposures.

Skill in assigning and leading the work of others.

Skill in preparing training and presenting formal claims management strategies, status and exposure to boards, attorneys, member entities, and relevant parties.

Education and Experience required for the essential duties:

Four-year degree at an accredited college or university in English, Liberal Arts, Public Administration, or Business and/or Finance.

Five (5) to ten (10) years of claims adjusting, or litigation experience required, experience working with public entities preferred.

Desired: Hold a J.D. from an ABA approved Law School, an Associate in Risk Management (ARM), and/or Associate in Claims (liability focus).

Senior Property and Liability Claims Adjuster

Annual Salary Range:$85,000 - $115,000

Type of Position: Full-Time

Description & Details:

The Senior Property and Liability Claims Adjuster, under supervision of the Director of Property and Liability, is responsible for the investigation, analysis, adjustment, reporting, settlement and recovery of public entity liability and property claims.

Duties/Responsibilities:

Analyze liability claims and first party property claims in accordance with relevant laws, county policies and procedures.

Evaluate claims for timeliness, accuracy, validity, circumstances, descriptions and related information for accurate claims processing.

Prepares, and sends, letters and notifications in response to claims filed against member counties'.

Reviews, investigates, and analyzes documents, notices, lawsuits and claim forms.

Analyzes claims and lawsuits for coverage purposes.

Using a degree of independent judgment, determines the best methods to actively manage claims in a timely and cost-effective method.

Executes an effective investigative strategy by obtaining information from member counties, interviewing witnesses and claimants, performing site visits and taking photographs.

Properly analyzes information to be able to make liability determinations and identity risk transfer opportunities.

Makes recommendations for handling to members including the settlement or rejection of claim, assignment of defense counsel and also vigorously pursues subrogation opportunities.

Works with experts to investigate and assess damages related to assigned claims.

Handles complex claims including litigated matters.

Provides and creates full captioned reports to member counties' and Trindel staff.

Authorizes and assures the prompt processing of checks for payment/settlement of claims.

Provides Trindel Executive Director, Property and Liability Director, and member counties' with monthly payment log/reports.

Recommends settlement/resolution for obtaining settlement authority under the provisions as provided by each member county. Including presentations to member county Board of Supervisors.

Coordinates and prepares information for external auditors, Trindel Board meetings, member counties' and regulators as needed.

Provides timely reports, updates and other statements information as needed to excess carriers, other insurers and agencies as necessary.

Regularly handles private and proprietary information while maintaining strict confidentiality and protecting information from unauthorized disclosure.

Respond in a timely manner to requests from member counties', claimants, attorneys or others for assistance by phone, e-mail, mail or site-visits.

Assures that Trindel policies and procedures are consistently followed.

Attend Trindel Board meetings, provide program updates as requested.

Perform other duties as assigned by the Director of Property and Liability Claims.

Required Skills/Abilities:

Physical Requirements:

Prolonged periods of sitting at a desk and working on a computer.

Must be able to lift up to 15 pounds at times.

Four-year degree at an accredited college in Public Administration, Business, Finance or related field.

Five (5) years of claims adjusting, or litigation experience required, experience working with public entities and/or Law Enforcement preferred.

Property and Liability Claims Adjuster

Annual Salary Range:   $65,000 - $97,000

The Property and Liability Claims Adjuster, under supervision of the Director of Property and Liability Claims, is responsible for the investigation, analysis, adjustment, reporting, settlement and recovery of public entity liability and property claims at the Direction of the Director of Property and Liability Claims. The Property and Liability Claims Adjuster executes client and company strategies to achieve claims quality, customer service, and operational objectives

The Property and Liability Claims Adjuster accomplishes this by analyzing loss trends, effective management of the claim cycle, setting/managing program reserves, conducting investigations, site visits, and active claim management.  This includes prompt processing of claims for payment, litigation management, excess carrier notification, managing Self-Insured Retention levels and effective use of claims management software. A critical job function is the effective referral and management of claims for litigation to minimize expenses when possible while providing effective claims management strategies and outcomes.
